Senate Committee Requires Child Proof Liquid Nicotine Packaging

This week, the Senate Commerce Committee, by a unanimous voice vote, approved legislation requiring child-resistant packaging for liquid nicotine containers sold at retailers. The legislation, which now goes to the full Senate, comes amid reports of dramatic spikes in the amount of calls to poison control center to deal with accidental nicotine exposures. Parallel legislation has also been introduced in the House of Representatives and is awaiting action in that chamber.

While the ATS is encouraged by the Senate legislation, we are concerned that Congress may not be able to enact this important legislation in a timely fashion. The ATS further notes that the Food and Drug Administration has the authority to regulate all tobacco products, including e-cigarettes and related products, and could require child resistant packaging through regulation. The ATS calls upon FDA to act quickly to use its authority to regulate all aspects of e-cigarettes, including requiring the use of child-resistant packaging for liquid nicotine containers.
