ATS Files Amicus Brief in the Cross State Air Pollution Rule Case

This week, the ATS filed an amicus brief, or “friend of the court” brief, in court challenges to the EPA’s Cross State Air Pollution Rule 2008 ozone standard update.  In this case, five states are suing the EPA in the D.C. District Court to stop implementation of a revised EPA rule that limits ozone air pollution generated in one state that is transported to another state.  The rule, often referred to as the “good neighbor rule,” requires power plants to reduce emissions that contribute to air quality violations in downwind states. 

In the brief, the ATS summarizes the known adverse health effects of ozone pollution to provide context for the court to consider the public health implications of blocking the EPA rule.  The ATS brief urged the court to reject state challenges and allow the EPA to move forward with full implementation of the Cross State Air Pollution Rule.
