ATS Joins Court Action in Support of Warning Labels for Cigars

This week the ATS joined other medical and public health groups in an amicus brief (insert link) supporting the FDA’s authority and obligation to require warning labels on cigar products in the case, Cigar Association v FDA.  The cigar industry, represented by the Cigar Association claims that Congress did not give the FDA the authority to regulate cigars and that the government has no compelling interest in requiring warning labels on cigars.  In response, the amicus brief filed by the ATS and other health groups lays out the legislative record where Congress grants the FDA authority to regulate tobacco products, the legal history granting the government the authority to require warning labels on hazardous products, extensive medical history of harms associated with cigar products, the long history of tobacco industry deception, and how the tobacco industry has sought to circumvent regulation of cigarettes by creating a new cigar product intended to appeal to children.
