EPA Requests Delay in Mercury Air Toxics Court Case

This week, the EPA petitioned the D.C. District Court of Appeals for a delay in hearing oral arguments in a case challenging the EPA 2012 rule to reduce mercury and other toxic pollutants from coal and oil-fired power plants. While the industry is already well on its way to meeting the 2012 standard, the Trump Administration EPA appears to be reconsidering whether it will defend this rule in court or will seek other executive actions to change the underlying regulation. The ATS has submitted an amicus brief in this case supporting the EPA 2012 rule and describing the anticipated health benefits from reducing mercury and other toxic emissions for power plants.
