FDA Issues Advanced Notice of Proposed Rule Making on Flavorings, including Menthol, in Tobacco Products

This week, the FDA Center for Tobacco Products issued an advanced notice of proposed rule-making seeking public input on the role of flavors, including menthol, in tobacco products.  The FDA is seeking comments, information and recommendations on whether and how the administration should regulate the use of flavoring in tobacco products. 

In issuing the request for comment, the FDA seems to be embracing a conflicted view of flavorings in tobacco products, both recognizing the role flavorings play in luring youth and young adults into tobacco initiations, while envisioning a positive role in encouraging tobacco users to switch to less harmful nicotine products.  As noted in the FDA request for public comment:

“While data show significant youth appeal and continued growth in youth and young adult use of flavored tobacco products, which can lead to lifelong tobacco product use, self-reported information from a study shows that some flavors in ENDS may play a positive role in helping some adults transition from cigarettes to potentially less harmful products.”

The ATS will respond to the FDA’s call for public input on flavoring in tobacco products.
