FDA Seeks Delay in Court Ordered E-Cigarette Application Deadline

This week, the Center for Tobacco Products at FDA petitioned the court for a 120-day extension in the court ordered deadline for e-cigarette companies to submit premarket tobacco applications for FDA review and determination. In its petition, FDA notes, “it is seeking the extension solely because of the coronavirus outbreak and would not do so but for these highly unusual circumstances.” If the court accepts FDA’s motion, the deadline for companies to submit new product applications will move from May 12 to September 6, 2020.
