Biden Administration Revokes Trump Rule – Grants States Authority to Set Vehicle GHG Standards
This week, the National Highway Traffic Safety Administration rescinded a Trump Administration policy that barred states from setting vehicle tailpipe emission standards for GHG that exceed federal standards. The Trump action was specifically targeted to block the state of California from implementing GHG emissions standards for vehicles. It is likely that the EPA will make parallel action next week to officially restore California’s waiver authority to establish vehicle tailpipe emissions standards.
