US Supreme Court Denies Challenge to California Flavor Tobacco Ban

In related court action, the U.S. Supreme Court denied an appeals request from the tobacco industry that was challenging the state of California’s ban on flavored tobacco products.  By refusing to hear the appeal, the U.S. Supreme Court has effectively affirmed the lower court ruling that California was within its state authority to ban flavored tobacco products and FDA regulation of tobacco products did not supersede or preclude further state action.

“This is a big win for California and other states that have banned flavored tobacco products.  As leaders in the ATS, we urge FDA ensure all Americans are protected from flavored tobacco products by issuing a final rule to ban menthol cigarette and flavored cigars.,” say Hasmeena Kathuria MD – Chair of the ATS Tobacco Action Committee.
